JACK KENNETH CONWAY [#45063], 84, of San Marino, was disbarred Dec. 20, 2014 and ordered to comply with rule 9.20 of the California Rules of Court. Jack K. Conway stipulated that he held himself out as entitled to practice law when he was suspended, failed to inform one judge of his status and submitted a forged document to another judge. In January 2013, Jack K. Conway was suspended for two years as a result of earlier misconduct. The order became effective on Aug. 30, 2013. Despite that fact, on Sept. 8, 2013, Jack K. Conway sent a letter to another attorney on behalf of a client asking to terminate his client’s spousal support and enclosed the necessary court document. A couple days later, he followed up with a voicemail message. That October, Jack K. Conway appeared before a judge in another case and was asked by the judge if he was eligible to practice law. Jack K. Conway assured the judge that he was, claiming that the effective date of his suspension had been extended and later presenting a letter to that effect purportedly written by a bar prosecutor. The letter was determined to be a forgery. Jack K. Conway was also involved in another case where the trial was set to begin on Sept. 6, 2013, after the start of his suspension. He did not notify the court of his suspension. Jack K. Conway represented his client during the four-day trial and it was not until after all the evidence had been presented that the trial judge learned of Jack K. Conway’s suspension. A mistrial was declared as a result. In mitigation, he entered into a prefiling stipulation with the State Bar. Jack K. Conway had two prior records of discipline. In 2013, he stipulated to misappropriating money he received on behalf of a client from a personal injury matter and to violating conditions of a 2011 private reproval by failing to meet two deadlines for submitting probation reports and failing to provide proof that he had taken and passed the MPRE. Jack K.  Conway received the private reproval in 2011 for failing to obey a court order or to perform.

August 30, 2013

JACK KENNETH CONWAY #45063, 83, of San Marino, was suspended for two years, stayed, placed on three years’ probation with an actual two-year suspension and ordered to take the MPRE, comply with rule 9.20 of the California Rules of Court, and pay restitution. The order took effect Aug. 30, 2013.

Conway stipulated to misappropriating $9,555.13 he received on behalf of a client from a personal injury matter, money that he later repaid. Conway also violated the conditions of a 2011 private reproval by failing to meet two deadlines for submitting probation reports and failing to provide proof that he had taken and passed the MPRE. Conway received the private reproval in 2011 for failing to obey a court order and to perform.
